I. GENERAL: No purchase necessary to enter or win. These are the official rules, (the “Official Rules”) for the “Satellite Sisters’ VTech ‘Sisters’ Getaway Weekend Contest" (the “Contest”). The Contest is sponsored by VTech Communications, Inc. (“Sponsor”), 9590 SW Gemini Drive, Suite 120, Beaverton, OR 97008 and administered by Golin/Harris International, Inc. (“Administrator”), 3200 Park Center Drive - Suite 750, Costa Mesa, California 92626. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations.
II. ELIGIBILITY: Entrants must be legal residents of the 50 United States or the District of Columbia 18 years of age or older at time of entry; provided, that residents of Rhode Island are NOT eligible to enter or win. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Sponsor, Administrator, Mudbath Productions, Inc. d/b/a Satellite Sisters or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prize, and their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW TO ENTER: To enter, email your answer to the following question: “Who do you call when the best or worst thing in the world happens to you?” to weekendgetaway@satellitesisters.com. Include your full name, address, phone number, and email address in the body of the email and state “VTech ‘Sisters’ Getaway Weekend Contest” in the email subject line. Entries remain the property of Sponsor and will not be returned or acknowledged. All entries must be received between 12:00AM PT on Monday May 19, 2008 and 11:59PM PT on Friday June 27, 2008 (the “Contest Period”).
Sponsor is not responsible for lost, late, misdirected, damaged, failed, partial or garbled entries/computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. If the Contest is terminated before the end date, Sponsor will determine the winner from all eligible entries received as of the termination date. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Contest. In the event of a dispute over an electronic entry, prize will be awarded to the authorized account holder of the e-mail account, not the name on the entry form. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
LIMIT: One entry per person/email address per day. A “day” is defined as the 24-hour period beginning at 12:00 AM PT and ending at 11:59 PM PT. Duplicate entries for a single individual during a day will be disqualified.
IV. WINNER SELECTION: One winner will be selected in a random drawing conducted on or about July 1, 2008 from among all eligible entries received during the Contest Period. Potential winner will be notified by phone and/or e-mail on or about July 3, 2008.
In the event the winner is deemed ineligible, fails to comply with Contest procedures, or is not available to claim prize during specified dates, then the prize will be forfeited and an awarded to an alternate winner.
Winner’s response to prize notification must be received by Sponsor within 10 days of prize notification or the prize will be forfeited and awarded to an alternate winner. Winner will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within same 10 day period or prize will be forfeited and awarded to an alternate winner. First prize winner’s travel companion will be required to sign a liability and publicity release (where legal) prior to ticketing. If travel companion is a minor, the winner must be that minor’s parent or legal guardian and must execute a liability and publicity release (where legal) on behalf of the minor.
LIMIT: People who have won any other prizes from Satellite Sisters within 90 days of entry are not eligible to enter this Contest.
Odds of winning depend on number of eligible entries received during the Contest Period.
V. PRIZE (1): Winner will receive: a trip for winner and travel companion for 3 days/ 2 nights to Seattle, Washington, including airfare (coach class) from major airport nearest winner’s residence to Seattle, Washington, dinner for 2 at the Metropolitan Grill, hotel accommodations (double occupancy, standard room) for 2 nights, 2 tickets to Jack Johnson concert and 2 DS 6121-3 phones. Approximate Retail Value (“ARV”) of first prize: $ 4968.39. Winner and travel companion will be required to travel on the same itinerary on leaving on August 22, 2008 and returning on August 24, 2008. If winner and travel companion cannot travel on these dates, prize will be forfeited and awarded to an alternate winner.
Winner will be responsible for all expenses not specifically included herein, and all applicable federal, state and local taxes. Winner is not entitled to exchange or transfer prize or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prize of equal or greater value.
VI. RELEASES: By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor, which shall be final in all respects. Failure to comply with these official rules may result in disqualification from the Contest. By participating in this Contest, entrants agree to release Sponsor, Administrator, Mudbath Productions, Inc. d/b/a Satellite Sisters, and their parents, subsidiaries, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Contest, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
VII. MISCELLANEOUS: By submitting entry materials, entrants (i) represent and warrant that such materials are original and created by entrant, that entrants have the necessary rights, permission and authority to submit such materials, and, if applicable, that entrants maintain a valid copyright in the materials and (ii) acknowledge that such materials may be included and/or discussed in Satellite Sister’s broadcasts and that such broadcasts may include statements or opinions by the broadcast talent or others about the entrants, the entrants’ appearances and/or the materials, and that those statements and opinions may be considered surprising, humiliating, embarrassing, derogatory, defamatory or otherwise offensive or injurious to entrants. Entrants release the Released Parties from any actions, claims, injury, loss or damage allegedly caused, directly or indirectly, by any such statements or opinions made during such broadcasts.
VIII. WINNER’S LIST: For the name of the winner, send a self-addressed, stamped envelope to Mudbath Productions, 18239 Ingomar Ave, Reseda, CA 91335 within 60 days after Contest end date. Vermont residents may omit return postage.
